Terms of Service

1. Agreement to these terms

These Terms of Service ("terms") are an agreement between you and aCaad ("aCaad", "we", "us"), the operator of acaad.app and its related sites, apps and APIs (together, the "service"). By creating, viewing or sharing a moment, or otherwise using the service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.

You must be at least 13 years old to use aCaad. If your local law sets a higher minimum age for consenting to online services, that age applies instead.

2. The service

aCaad lets you create personalized digital cards, called moments, combining text, images, music, voice recordings, animations and effects; watch them play; share them by link; download them as video; and optionally attach gifts. Core creation and viewing are free and work without an account.

3. Using aCaad without an account

When you use aCaad without signing up, a random guest token on your device keeps your drafts and cards together. Keep in mind that the token lives in your browser: if you clear your browser data or switch devices without signing up, we may have no way to connect you back to your cards. Fair-use limits apply to anonymous creation to keep the service free for everyone.

4. Accounts

An account is optional and adds convenience: a dashboard, sync across devices, higher limits, and claiming cards you made as a guest. You are responsible for your sign-in credentials and for what happens under your account. Tell us right away at hello@acaad.app if you believe your account has been compromised. You can delete your account at any time from settings.

5. Your content

Everything you put into a moment stays yours: your words, your recordings, your images, your choices. We claim no ownership.

So the service can function, you grant aCaad a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (for example transcoding and rendering into video), display and transmit your content, solely to operate, provide and improve the service: playing your moment for the people you share it with, producing the downloads you request, and keeping backups. The license ends when your content is deleted, except for short-lived backups and copies already delivered to the people you shared with.

You are responsible for having the rights to what you upload: your photos, your audio, your text. Do not upload content that infringes someone else's copyright, trademark or privacy.

We do not use your content to train AI models, and we do not sell it.

6. Voice rules

Voice is powerful, so the rules are strict and simple:

• Clone only your own voice, or the voice of a person who has clearly given you permission.
• No impersonation. Never use a recorded or cloned voice to pretend to be someone in a way meant to deceive, defraud or harm.
• No harmful synthetic speech. Do not generate speech that harasses, threatens or misleads.

We may remove voice clones and content that break these rules and, for serious or repeated abuse, suspend access to voice features or the service. If you believe your voice has been used on aCaad without your permission, contact hello@acaad.app and we will act quickly.

7. Acceptable use

Do not use the service to:

• Harass, threaten, defame or abuse anyone, or send content to someone who has made clear they do not want it.
• Break the law, promote violence, or exploit or endanger minors in any way.
• Deceive people: scams, phishing, impersonation, or misleading synthetic media.
• Send spam or bulk unsolicited messages, or use bulk features to reach people who have not agreed to hear from you.
• Upload malware or content designed to damage devices or steal data.
• Probe, overload, scrape or disrupt the service, bypass rate limits or bot protection, or access other people's data.

We may remove content and restrict accounts that violate this section. Where the law requires it, we will report serious abuse to the relevant authorities.

8. AI features

Optional AI features can suggest message text, narrate with a synthetic voice, or generate background music. AI output can be imperfect: review what it wrote or made before you send it, because the moment goes out under your name. You are responsible for AI-assisted content you choose to share. How these features handle your content is described in our Privacy Policy.

9. Gift cards

You can attach a gift card to a moment. Gift cards are issued, sold and redeemed by third-party merchants and providers under their own terms; aCaad facilitates the attachment and reveal experience. Purchases are processed by the relevant provider, and redemption questions are governed by the issuer's terms. Some gift links are affiliate links, and aCaad may earn a commission at no extra cost to you. We are not responsible for an issuer's failure to honor a card, though we will help you chase it.

10. Free, registered and premium

The core of aCaad is free: creating, sharing, viewing and downloading moments. Registered accounts add convenience at no cost. A premium tier adds more, such as bulk generation, advanced exports and higher limits.

For paid features, the price and what it includes are shown before you pay. Unless stated otherwise at purchase, subscriptions renew automatically and can be cancelled any time, taking effect at the end of the paid period. Where required by law, you keep your statutory refund rights. We may change free-tier limits and features as the service evolves, and we will not remove a moment you already shared just because a limit changed.

11. Our intellectual property

The service itself, including the aCaad name, logo, design, templates, animations and software, belongs to aCaad and its licensors. We give you a personal, non-exclusive, non-transferable right to use it as these terms allow. Do not copy, resell or reverse engineer the service, except where the law says we cannot restrict that. Feedback you send us may be used to improve the service without obligation to you.

12. Availability and disclaimers

We work hard to keep aCaad fast and reliable, and we still cannot promise perfection. The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the extent the law allows. We do not guarantee that the service will be uninterrupted, error-free, or that any particular moment, file or feature will be available forever. Keep your own copies of recordings that matter deeply to you: download the video.

13. Limitation of liability

To the maximum extent the law allows, aCaad will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for all claims related to the service is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.

Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, or limits consumer rights you hold under mandatory local law.

14. Suspension and ending use

You can stop using aCaad at any time, and delete your account and content. We may suspend or end access to the service for accounts or tokens that violate these terms, create risk for other users, or trigger legal exposure, using the least drastic measure that fixes the problem where practical. Sections that by their nature should survive (your content license during wind-down, disclaimers, liability limits, disputes) survive termination.

15. Governing law and disputes

These terms are governed by the laws of the jurisdiction where aCaad is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction. If the mandatory consumer-protection law of the country where you live gives you additional rights or a right to sue at home, those rights are not affected. Before going to court, talk to us: most problems are fixable at hello@acaad.app.

16. Changes to these terms

As aCaad grows, these terms will evolve. When we make a material change we will update the date at the top and give notice inside the app before the change takes effect. Continuing to use the service after that date means you accept the updated terms. If you do not, stop using the service and, if you have an account, you may delete it.
